Terms of Service
These terms govern access to Bullpen at runbullpen.com. By creating an account or using the product you agree to them. If you are signing up for a shop, you represent that you can bind that shop.
The product
Bullpen is software for MCA shops. It drafts and sends texts through numbers you assign, collects bank statements, and queues deals for a human to price. Bullpen is not a lender, broker of record, or bank. We do not underwrite, approve, or fund merchants. Any dollar amount, factor, payment, or term a merchant sees must come from your team.
Your account
Keep credentials confidential. You are responsible for activity under your users. Shop owners control invites, roles, and which agents can send. We may suspend access for abuse, unpaid invoices, or legal risk.
Messaging and compliance
You are the sender of every merchant text. You must have a lawful basis to contact each number, honor quiet hours and frequency rules that apply to your program, and keep consent records. Bullpen will suppress STOP and similar opt-outs on lines we operate; you still own TCPA, CAN-SPAM, and state-law compliance for your campaigns.
Do not use Bullpen to spam, phish, impersonate a government agency, originate credit terms the merchant did not receive from you, or text people who have opted out.
Agents and AI
Agent replies are generated from your language banks, temperature, and thread context, then checked against platform guardrails. The model can still be wrong. You must review escalations, identity holds, and needs-terms queues. You may not configure an agent to claim it is human, to quote rates or amounts you did not enter, or to promise approval.
Your data
You retain rights in the lists, threads, offers, and files you put in Bullpen. You grant us a license to host, process, and display that data solely to provide the service. Statement files are stored so your shop can underwrite; we do not use them to train third-party foundation models. See the Privacy Policy for how we handle personal information.
Vendors
The product depends on hosting, database, object storage, email, messaging, bank-linking, and LLM providers. Outages or policy changes at those vendors can affect send, collection, or generation. We will use commercially reasonable efforts to restore service.
Acceptable use
You will not:
- Probe, scrape, or overload the service beyond ordinary use
- Circumvent shop isolation, auth, or rate limits
- Upload malware or content you do not have rights to process
- Reverse engineer the product except where the law allows it
Disclaimer and liability
The service is provided “as is.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent the law allows. We are not liable for lost deals, failed sends, model errors, or third-party outages. Our total liability for claims arising out of these terms is limited to the fees you paid us in the three months before the claim (or one hundred dollars if you have not paid fees).
Indemnity
You will defend and indemnify Bullpen against claims arising from your campaigns, your merchants, your terms, or your violation of these terms or messaging law.
Termination
Either side may stop using or providing the service. On termination we will disable sending. You may request export or deletion of shop data as described in the Privacy Policy, subject to suppressions and records we must keep.
Law
These terms are governed by the laws of the State of New York, excluding conflict-of-law rules. Exclusive venue is the state or federal courts located in New York County, New York, except that we may seek injunctive relief anywhere.
Changes
We may update these terms. Continued use after the updated date above is acceptance. Material changes will be flagged to shop owners by email or in the product.
